This page outlines the procedures for copyright holders to notify us of alleged copyright infringement on dsgexpert.com. It also details the process for users to submit a counter-notification if their content has been removed due to a mistake or misidentification.

Filing a DMCA Takedown Notice

If you believe that material on dsgexpert.com infringes on your copyright, you may send us a formal DMCA Takedown Notice. Please send your notice to our designated agent, ensuring it includes all the following required elements:

  • A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
  • Identification of the copyrighted work claimed to have been infringed. Please provide enough detail for us to locate the work, such as a URL or a specific description of the content.
  • Identification of the material claimed to be infringing or to be the subject of infringing activity. Include information reasonably sufficient to allow us to locate the material on dsgexpert.com, such as a specific URL for each infringing piece of content.
  • Your contact information. This must include your full legal name, mailing address, telephone number, and email address.
  • A statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Counter-Notification Process

If your content was removed from dsgexpert.com as a result of a DMCA Takedown Notice, and you believe it was removed by mistake or misidentification, you have the right to submit a counter-notification. A counter-notice will be effective if it includes substantially the following information:

  • Your physical or electronic signature.
  • Identification of the material that was removed and the location where the material appeared before it was removed.
  • A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which dsgexpert.com may be found. You must also state that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, we will forward a copy to the complaining party. We will then wait for approximately 10 to 14 business days before restoring the removed content, unless the complaining party files an action seeking a court order to restrain the user from engaging in infringing activity related to the material.

Repeat Infringer Policy

Design Expert maintains a strict policy regarding repeat infringers. We will terminate access for users who are determined to be repeat copyright infringers. This includes users who have been notified of infringing activity more than once and/or have had infringing content removed from the website on multiple occasions.
